I was talking about this with a friend who's a lawyer. He said that in other contexts, having a rule and being lax in enforcement usually puts you in a worse legal position than having no rule at all. Do the lawyers here agree? If so, it seems like the Pac-12 might have some problems down the road.

While I am just a recovering attorney, I would love to put a blow-up of that instagram photo on an eisel in front of a civil jury during cross-examination of the Pac-12 official that ruled that there was no violation of the rule.

I don't remember too many Stanford players making illegal hits. There was this Shayne Skov hit on Jared Goff in the helmet area a couple years ago, but I don't think he was concussed. Nevertheless, given today's rules, and what we are advocating against, it should have been flagged.
