The NCAA formed a Transformation Committee in October, 2021 to "examine issues pertaining to Division I from every angle and put forward a sweeping series of recommendations for modernization. Our goal has been to ensure that our Division I systems fundamentally support the needs of current and future student-athletes." The Committee included P12 representatives Patrick Chun, WSU AD and Bob Jacobsen, Cal faculty athletic rep.
The Committee has just issued its final report available here -
https://images.saymedia-content.com/.image/cs_srgb/MTk0OTA3MTk4ODU2MzczNzg0/final-ditc-report-with-addendum%E2%80%94123022.pdf
Like most committee reports, it offers recommendations for others to take forward. But it also punted on key issues including NIL and the employment status of athletes. The Committee said that the NCAA cannot address these issues without Congressional action. Emphasis below is mine.
Quote:The contents of this report represent the deliberations, evaluations, and actions on some of the biggest challenges facing Division I athletics. In our time, we have made great strides in achieving that charge. However, many issues remain unaddressed. In the vast majority of those cases – as it pertains to issues such as name, image & likeness standards, the employment status of student-athletes, and the unique interests of student-athletes in the highest revenue-generating athletic programs – this stems from legal and other uncertainties. The NCAA is prepared and eager to engage on these issues. There’s no question that finding fair, sustainable, and equitable resolutions to each issue will be essential to Division I’s future. We simply need a clear, stable framework under which to address them.
Congress is the only entity that can grant that stability. Since the next phase of NCAA transformation will hinge on these issues, the NCAA has initiated and established a Board of Governors Subcommittee on Congressional Engagement. They will now take responsibility for the advancement of the unfinished pieces of the Transformation Committee’s work where the NCAA currently lacks the ability to self-impose changes on its own. The Subcommittee will also lead the NCAA’s strategy for engaging, motivating, and collaborating with Congress over the coming year.
In a very related story, college football coaches know that tampering with their players is rampant but won't do anything about it.

Cal's best player and former Stanford recruit, Frosh WR J. Michael Sturdivant, hits the portal. Cal fans are divided between it being an issue of not enough NIL money, or just uncertainty with Cal's offense/new OC/QB situation. Might be a bit of everything, but Cal fans act like they are just gonna be picked apart by other programs because they have no big donors to foot the bill. Not all programs are gonna leave themselves so vulnerable, as this suggests:
https://frontofficesports.com/tulane-nil-cotton-bowl/
I've wondered ever since this mad dash to Wild West player acquisition evolved if coaching salaries would take a hit because donors would want to put the money into paying players to play for their schools, rather than hiring coaches to recruit and coach. It seems this is a very realistic possibility, if not inevitable.
Saw a post from a Cal donor saying he wants to split his donation between the school and an NIL collective (and the school to tell him the collective it endorses). The rub is if you give 50% to school and 50% to collective to pay players, you lose 50% of your tax deduction. But I'm pretty sure the big money donors who want to win aren't interested in tax deductions anyway.
At the end of the day, recruiting High School players is for chumps if you can just recruit proven college players to build your team. This seems to be the USC MO. As I told a friend after the Cotton Bowl loss, expect them to go out and buy a roster of great defensive players this offseason.
Stanford really is in position to handle transfer poaching better than most programs given the fact the Stanford degree is so coveted and valuable. If Troy Taylor and staff can recruit and develop the players they recruit, Stanford could be in a good competitive situation in the NIL/transfer (unregulated free agency) era of college sports. But it certainly would be a good idea to get a serious NIL collective going nevertheless, as a hedge against departures for cash that can't be turned down.
I mean how much would a 2010 Andrew Luck be worth if he existed 12 years later in this crazy market? Would Stanford be at risk of losing him for I don't know a $1M NIL deal with Texas? Or would he turn that money down for a Stanford education and Stanford Football?

Luck was exceedingly unusual. I mean, he could have left for the NFL as the first pick of the draft and opted to come back to graduate at Stanford, which tells you a lot about Luck, and relatively little about Stanford. For every Andrew Luck, there's a Christian McCaffrey, who as his mom puts it, is a Stanford dropout.

I suspect that for every Andrew Luck there are at least 10 CMacs, in terms of going to the NFL in the same situation.

Agreed for Luck if money was the main factor he just would have gone pro.
Where those NIL deals would be extra enticing though are for the college stars who aren’t top pro prospects or for star underclassmen who can’t declare yet. A QB hungry team throwing a couple million bucks at Duggan from TCU would make a lot of sense for both parties.

Duggan, a senior with no eligibility remaining, was a bad example. But this is absolutely happening with others (cough cough Sam Hartman to Notre Dame and Devin Leary to Kentucky).

More insight into the J. Michael Strudivant situation.
Apparently, his personal trainer is acting as his agent, and started talks with other schools before he even entered the portal, which is suppose to be "illegal" per NCAA "rules."
This is why I DGAF and find no reason to be especially bothered by Michigan supposedly breaking NCAA rules. The NCAA effectively has unregulated year-to-year free agency for all athletes right now. Even worse, the money to acquire the talent isn't even coming form the schools. It's coming from outside donors who aren't suppose to be talking with the coaches about the players being acquired or the money they are getting. It's conceivable a college team coaching staff doesn't choose a single player on their team - so donors buy the roster - the way the market for college athletes has evolved.
I don't see how this is sustainable.

If you think the NIL and Free Agency/Transfer for $$$ is chaotic now just wait until the gambling industry gets their hooks into the NIL.

Pittsburg High 5-Star QB Jaden Rashada orally committed to Miami. With allegedly a $9.5 Million NIL deal. He denied it, saying the reports were not accurate and that he’d never make a “life/career choice for monetary value.” He was choosing Miami because of the relationships he had with the coaches and the direction of the program. That was until Florida came calling. With a $13 million NIL deal. Suddenly, he realized he had dreamed of playing in the SEC since he was a little kid. So, he signed with Florida. But….. That NIL deal reportedly fell apart. So, there are reports he is de committing. He was going to enroll early, the deadline was Friday and it is not known if he registered.
Welcome to the New World of College football.
BTW, Oregon is supposedly becoming the Texas A&M of the PAC Whateversleft. Gotta believe a lot of Nike. After all, that program is a wholly owned subsidiary of Phil Knight….

Since Rashada signed a Letter of Intent, he must be released by Florida before he can go elsewhere. Of course, no one wants a guy who doesn’t want to play for them. What a mess….

Everyone but Florida loving this and hoping for an ugly lawsuit.
Need headlines like this to really push Congress to get involved to effectively limit NIL.

IMO, a "Ponzi Scheme" has become a term for "a financial scheme that someone doesn't happen to like".

One of the unpleasant things about NIL is that it may be a distraction for the players. Rather than just concentrate on athletics & school & social life, these athletes now have another thing to deal with & stress about: money/investments & agents & obligations & maybe travel.
People on this board are suggesting that Stanford WBB players are tired. I wouldn't think they should be. They're not in a crunch time for academics. Their game schedule is back to normal after a very heavy autumn. They probably play less time than starters for almost any other school. (I will say they do play hard when they play. And practices are probably strenuous.)
I have to believe the coaches try to emphasize to the players about sleep time, but that doesn't mean the players actually sleep.
As a fan, I am at least suspicious that the weight of NIL is impacting the play. I don't particularly like that thought, but it is there.
"Wow, look, my stocks did well, so I am up $50K over yesterday.
I heard about something neat in class today, so I need to tell my broker to invest in it.
I didn't read what the prospectus for what she said I should think about.
That reminds me, I forgot to read through the liability insurance contract and I've promised to sign it tomorrow." etc.

Here's a good (and long) article about the effects of NIL on athletics departments, with a focus on North Carolina:
https://www.nytimes.com/2023/01/24/magazine/ncaa-nba-student-athlete.html
The tl,dr is that money that once went to the whole department is now going to individual players, and it's not clear how departments are going to make up for that. It's not an encouraging read if you're a fan of any sport besides basketball and football.
