Ivy League won't be forced to provide athletic scholarships - dabigv13 - 10-10-2024

I think this lawsuit was discussed previously when it was filed, but couldn't find the thread.

Seems like one of the first losses for "student athletes" in court in the post Alston era, though not sure this ruling has any relevance to other ongoing legal challenges like the Dartmouth employee/union case with the NLRB (was curious about that as well so posted a recent article below on that) or the House case.

Quote:The Ivy League and its eight member schools scored a victory in court on Thursday when a federal judge in Connecticut dismissed a lawsuit accusing their agreement to not provide athletic scholarships and not pay Ivy League athletes compensation of amounting to an antitrust violation.

The core problem with Choh & Kirk v. Brown University et al., U.S. District Judge Alvin W. Thompson explained in his 36-page order, is that the case doesn’t adequately identify a relevant market for antitrust scrutiny.

Quote:It’s been nearly eight months since NLRB regional director Laura Sacks found that Dartmouth College men’s basketball players are employees within the meaning of the National Labor Relations Act. And it’s been seven months since the players unionized with the Services Employees International Union Local 560. But to date there has no bargaining between Dartmouth and the union, and the agency’s board hasn’t indicated if it will accept Dartmouth’s request for review (appeal), let alone set a schedule.
