The Senate being in official recess, Obama has until dawn Monday, Eastern Time, to make a recess appointment that lasts until 3 January 2017, when the next Congress is sworn in. Although Republicans will surely squawk, Eisenhower made three recess appointments (Earl Warren, William Brennan, Potter Stewart).
Following up on an above suggestion, Obama could name Jon Huntsman, a Republican who is his former ambassador to China. Various articles speculating on other Republicans who might draw little GOP fire, yet be acceptable to the Democratic base, have mentioned Nevada Governor, Brian Sandoval.
