The prosecution's most powerful testimony/evidence would be the voice of the victim, which iirc is the biggest reason why a victim's refusal to cooperate usually (but not always) dissuades prosecutors from pressing charges.  A defense attorney could just point at the absence of the victim and claim that as proof of innocence.
