So, here is a question. If the statute had been written as:
"The canning, processing, preserving, freezing, drying, marketing, storing, packing for shipment or distributing of:
(1) Agricultural produce;
(2) Meat and fish products; and
(3) Perishable foods."
would an Oxford comma have been needed?
Also, what gives with "marketing"? Who cares about overtime for people responsible for marketing agricultural produce.
