A technical point but one that I think is worth noting. Title IX will not kill the settlement nor will the settlement itself be litigated with respect to Title IX claims. The settlement is simply setting basic parameters regarding issues such as revenue sharing and scholarship deregulation. The only thing that is firm is the backpay that will come out of NCAA coffers and individual school’s future shares of revenue received from NCAA payouts (based largely on the basketball tournament). Individual athletic programs will have lots of latitude to navigate how they want to handle issues such as revenue sharing going forward. It is those attempts to navigate these issues that I suspect will open the individual schools/athletic departments up to Title IX challenges.
