I don’t think they’re gonna wanna make it that much more difficult. In any event not the place to debate this. I do invite people to read Cal OSHA’s regs on this.

But I will say this, as it’s sports related:  OF do you believe the MLB players Union would agree that the players must be vaccinated or they can’t play?  I suspect that’s highly unlikely.

1. The employer dilemma in getting people physically back to work has nothing (or close to nothing) to do with a vaccination requirement; but rather, the fact that people like working from home and valuable employees will be accommodated.  THAT is the problem . . . afaict.

2.  Lex, why do you think the union would oppose a vaccination requirement?  And btw, OF's compromise seems very reasonable.

Because there are players, I suspect, that don’t trust and don’t want the vaccine.  The compromise they (and also the NBA) made was once a team reaches the 85%  level things loosen up.  I can’t see the Union agreeing to anything that means some players get shut out.  There is such a lack of trust between the Union and MLB management that it’s hard to get agreement on anything. A strike next year is a major possibility.

For private employers, religious accommodations are governed by Title VII of the Civil Rights Act, not the Constitution. If it's not a governmental entity that is alleged to have discriminated, Titles II, VI, VII, VIII and IX of the CRA tend to be the source of legal obligation and liability.
