This is known as out-of-home viewing (OOH) and Nielsen does try to track it. They have a random sample of households, and they ask some of those household members to carry around a device that has a microphone, which picks up an audio fingerprint embedded in TV content.
In your bar/restaurant example if there are 100 people within earshot of the TVs, in theory the broadcast will get credit for more viewers than a single house, because the chances are higher that one of the 100 will be a Nielsen household with the device.

So, they could be eating a hamburger in a bar, facing away from the TV screen and still be counted as watching the game. Silly.

Remember that the main point of tracking ratings is to sell ads against the audience, so they mostly care how many people can see/hear the ads.
