Stanley Wilson Shot -
BostonCard - 06-24-2016
Kind of a bizarre story:
http://www.foxnews.com/sports/2016/06/24/naked-intruder-shot-by-oregon-homeowner-turns-out-to-be-ex-nfl-player.html?intcmp=hplnws
He breaks in naked to a neighbors home, who shoots him.Â

Same time you stop craning your neck to see the car crash on the highway?

I'm actually really good at resisting the urge to rubberneck. Though I do usually ask my passenger(s) to describe what they saw.

The DA may have overcharged the offense. Unless he actually broke into someone's house, he probably won't serve time. Heck, rapists get only 6 months these days. The bigger issues for Wilson are recovering from the gunshot wound and recovering from whatever problems contributed to him ending up naked in some stranger's fountain.

It's a sad world where you get shot for being naked in a stranger's fountain.

I suspect the prosecutors charged attempted burglary in order to excuse not charging the rifleman. ORS § 161.219 provides:
Quote:
Limitations on use of deadly physical force in defense of a person
Notwithstanding the provisions of ORS 161.209 (Use of physical force in defense of a person), a person is not justified in using deadly physical force upon another person unless the person reasonably believes that the other person is:
(1) Committing or attempting to commit a felony involving the use or threatened imminent use of physical force against a person; or
(2) Committing or attempting to commit a burglary in a dwelling; or
(3) Using or about to use unlawful deadly physical force against a person. [1971 c.743 §23]

I hope we get the whole story. I've had several friends over the years end up in a wrong house or yard after a night of drinking. Thank god the homeowners weren't packing heat and itching to use it.
Doesn't sound like a robbery. That homeowner should've called the cops and locked the door.

If the attempted burglary charge goes away, does the homeowner still get a pass for shooting Wilson? (Just an academic thought)

Based on the way the statute was written, the homeowner probably still gets a pass (depending on circumstances), under the phrasing "the person reasonably believes that the other person is: Committing or attempting to commit a burglary in a dwelling" I think even if not charged, the homeowner might have a case by saying, "I reasonably thought he was going to try to burgle my house". The fact that Wilson was charged helps a lot, since it was "reasonable" enough that the DA brought charges.

I can certainly imagine relatively innocent explanations of what we initially heard -- ("
I was headed to bed and the cat wanted in, but then I got locked out. So I went to several neighbors' to try to find a hammer to break out a window. I'd been looking for one for 3 and a half hours") or even believable explanations ("
I was under the influence and thought I was a merman") -- and I'd be happy if they were true. But I'd have thought any innocent explanation would have come out immediately after Wilson was asked what happened.Â

Don't think so, but couldn't say definitively. Generally the homeowners were pretty understanding as I seem to recall.
