Kelly Presser - WhatsYourDeal - 09-25-2018

This quote from BK's presser is entertaining:

Quote:"I think there's some similarities [between Stanford and ND] in the sense that we both are trying to achieve excellence both in the classroom and on the football field as our primary mission. For us it's a little bit probably much more of a grander scheme in terms of coast to coast. But you know, they've got a strong academic and a strong alumni base, as well. But yeah, I think the excellence piece, both on the field and the classroom, is probably the similarities."

RE: Kelly Presser - fullmetal - 09-26-2018

Brian Kelly's program killed a video intern.  His first year saw a woman kill herself after being raped by a Notre Dame football player and unable to seek justice.  His golden boy linebacker Manti Te'o carried on a nationally-known hoax about a fake girlfriend with cancer -- and then that team promptly folded like a cheap suit against Alabama in the title game.

There's nothing left of Notre Dame's legacy to truly admire.  They're just another wanna-be football factory.

RE: Kelly Presser - Phogge - 09-27-2018

As I reported on TOS years ago, I conducted an informal survey of NFL team video directors whom I ran into while shooting games. To a man they said that they would have come down from a perch above the practice field in high wind. They also said that the NFL coaches would have either ordered them down or concurred with their decision.

Kelly and Swarbrick were at fault and should have faced charges. Maybe so all the assistant coaches. Declan’s family supported the school. Big questions re a possible payoff. It is obvious what institution runs the City of South Bend.

What’s Oliver Stone waiting for?

im breaking my own rule here by going beyond my own thread but i just can't help myself here.  I am fine with people not liking Kelly, you think he is a giant a$$ who can't coach, etc.  I don't care. Make fun of him for yelling on the sidelines early in his career, whatever.  I am personally to the point that i think we may be getting near a switch, not because he can't coach, but it maybe mutually beneficially to both ND and Kelly for a change, a fresh breath.  I would expect him to move on and do very well.  Ultimately, he saved ND football, things were very very bad when he took over, he brought them back to being a relevant program, upgraded the stadium, has put players in the NFL, etc.

But the 2 issues that i just can't control myself on is the death of Declan Sullivan and Lizzy Seeberg.  Both of these are absolutely terrible stories.  But people shouldn't use them to attack Kelly.  First with Lizzy,  can i see the story she told as being true, absolutely. However, i spoke to an ND police officer friend and he told me there was no proof at all that anything had happened.  Obviously Lizzy was a mentally ill girl and i feel sympathy for her and her family.  The stories that Kelly and Co. were covering up and protecting Prince Shembo, i just don't believe.  I think it was a situation where had their been proof, Kelly would have dealt with it.  But he could have faced lawsuits coming the other way had he dismissed a kid without any proof.  So what do you do?  Say Prince SHembo is your kid.  A girl accuses him, do you instantly find him guilty, or are you going demand that someone prove it.  The ND police did investigate it, they are state police, and honestly i think some of them enjoy busting ND football players more then regular players.  I think kelly was in a no win.  You kick a kid off with no proof, or you keep a kid on not knowing if it true or not.  Heck i could show up tomorrow and say David Shaw assaulted me. Do you fire him immediately?   A lot of the information being spread around just is not true, so please don't get too caught up in that info.  I could see a situation where they were messing around at a party, things got out of hand (could have been either one pushing it) and that was that.  I have 0 sympathy for any person who sexually assaults another person, but there was no history at the time of this behavior by Shembo and no evidence he did it.  He said she came on to him, she said he came on to her.  What can you do in that situation?  Now, lastly on this, do i also believe that higher ups at the university could have tried and squashed this story once she had already committed suicide to try and "protect" the university - i absolutely believe there are people at the top who think that way, but thats not Kelly.  The thing is, ND is not like some of the other universities, Kelly is not the king of the land.  He does not call the shots, he runs the football team and that is it.   Trust me, he does not get his way more times then he does.   He is constantly overruled on decisions involving coaches and activities, etc.

Secondly, Declan Sullivan, a very tragic story.  I full believe the University is fully responsible for not having better safety procedures and management in place to prevent an accident like this from happening - but its not Kelly's fault.  Unless you can show me where he went over to that kid on that day and said hey i know its windy, get up there, then its not on him.  Because once again, the university runs everything.  A place ran like this, should have a safety office that overseas all of their employees and their actions every day.  Also, and this is more significant, his family, has continued to support the university and has told people to stop using their sons death in their complaints about the university.  They continued to show up to football games THAT YEAR, accepted the responsibility of the university, did not take any information on this public and have never once blamed Kelly, so how can you?   And don't give me the payout crap.  There is no amount of money, and i am not a wealthy man, that could ever make me support a man if i thought he was responsible for the death of my son.  Their other child applied to the university after this event.  Numerous times have preached against this kind of behavior.  So once again, ND responsible, yes, they have accepted it and made changed to prevent it.

if you want to shame the university thats fine, but not kelly.  There is potential that they did not do their due diligence in one story and they were not prepared in the other.  Without specific proof kelly was involved in either one, i don't hang that on him.  There are other things you can hate about him, but not these.  Alot of fake stories out there about both these stories.

Sorry for the rant... i don't agree with everything kelly said in his presser.  I think, as he often does, did not mean it how it sounded though.  If he would have stopped at both universities recruit the same kind of kid, that would have been fine, but he did take it too far after that.  I believe the coast to coast comment was more in line with our schedule and recruiting.

RE: Kelly Presser - Phogge - 09-27-2018

With all due respect and without an indictment I would take the word of eight or nine veteran PROFESSIONAL video directors that Kelly should have ordered the kid down. Remember, Declan sent a tweet that explicitly said he was very afraid. Kelly was the commanding general of the practice field and he shirked his responsibilities in the case. No excuse. Digitally recording the practice takes no precedence over protecting NOTRE DAME personnel from death or injury.

My god, on a shoot we sometimes need OSHA to approve some conditions. Electrical tie-ins, generator position vis a vis nearby debris and vegetation, overhead lines, etc.

Sorry, but the kid died. Somebody is responsible. Shame on the DA.

And that is why i am saying the university is responsible.  He was a university employee, not Kellys - he didn't interview and hire him and negotiate a salary.  ND was responsible for his safety.  There should have been a safety team in place to cover all university employee activities.  Maybe they have a safety team or group and they weren't doing their job or maybe they didn't have one at all.  But it is the universities responsibility, starting with the Athletic Director and going up from there - they were the ones would should be blamed, not Kelly.

"Digitally recording the practice takes no precedence over protecting NOTRE DAME personnel from death or injury." - obviously that should be the case.  This was not a situation where they were valuing the film over safety, this was a case where the university was not taking the correct safety procedures - they were being dumb.  Now, if kelly ordered him up there, or saw a safety violation and didn't say anything then you can put blame on him.  But do you think he looked at the weather and said hey its 45 mph winds and those are only rated for 25, lets not send them up there?  No that should be someone elses job.

The university is responsible for the safety of every employee, not Kelly.  And regardless, with all due respect, you went over my point that if the parents have first call on blame and responsibility.

RE: Kelly Presser - OutsiderFan - 09-27-2018

Another thing about Sullivan. It's not like he couldn't have taken the scissor lift down and protected himself when he felt it was dangerous. This is the part that has confused me about the hole sorry episode. Why on Earth did he stay up there?  Was he thinking he'd be admonished or fired if he got down?  It's impossible for me to believe he would have been told anything other than "glad you got down."

So while I agree some measure of occupational safety should ideally have been in place. I don't need someone ordering me to avoid driving into oncoming traffic either. Sometimes people are at fault for mishaps simply due to doing dumb things of their own volition.

Just watch any number of YouTube videos of people doing dumb things and paying a price for it, to prove my point.

I agree he could have went down, and should have on his own - but that does not excuse the responsibility of the university. Yes each person can make their own choices, but there should have been measures in place to make sure he never went up.  I believe that is a big reason why the parents feel the way they do about the university.

I do not know enough about what happened to have an opinion on this case overall, but I do know enough about how Universities work to know that what you are describing is misleading.

UND being responsible for his safety means that individual people in supervisory roles are responsible - it does not mean that some faceless, non-human entity is responsible. And in a practical sense, it doesn't mean that the University President (or the like) is responsible for day to day, in the moment decisions.

The employee's direct supervisor and the supervisory chain would be responsible. Kelly was likely not the former, but certainly part of the latter. He also was likely the most senior link in the supervisory chain on the scene in the moment, and as such he would likely bear the largest share of responsibility for any immediate decisions made, or not made.

Now I have no idea how obvious the situation was at the time, or how well UND has trained Kelly about his supervisory responsibility, how well UND has ensured that the a proper safety review and analysis is in place, etc. But it is meaningless to say it is the University's responsibility and not Kelly's because Kelly was the relevant representative of the university at the time.

i can understand and appreciate your point. ironically, i believe the AD was actually there when this happened, but that is not the normal.  I believe that a part of the punishment could have been thrown at kelly, but i don't believe it is right to say it is his fault that this event happened.  And i partially went off more here then i should have because i recently got into with a guy who was calling kelly a murderer for this exact event.  I did not mean to describe this as a faceless entity being responsible for all this, but rather people in charge to regularly go over safety procedures, give recommendations due to weather on the days activities and make sure everyone is generally acting safe.  Much like at my office, whenever we have to do a daily activity we are reminded of the risks and how to act safely.  I think my main point was people who were just throwing this at kelly because he was there and because they don't like him.  I think that if kelly saw it and ignored it, or the kid tried to leave and kelly said no, or even told the kid from the beginning to get up there, then he has direct responsibility for the event.  But in all likelihood, he never interacted with the kid and if he never saw it,then he is far from a heartless murderer.

RE: Kelly Presser - Phogge - 09-27-2018

Hey, never went to indictment. Probably mostly because of the university’s power in the city. You can bet the house that if this had happened on UC’s practice field a chorus of voices would have risen demanding an investigation.

Always had a problem with Notre Dame entitlement and disagree with many things in my Catholic faith. So, I admit I am prejudiced but Kelly was responsible at that moment in time and failed to protect a terrified kid whether scared to admit it to the heir to the Rockne/Rudy legend or not.

Hope nobody suffers a serious injury Saturday.

RE: Kelly Presser - Redrum - 09-27-2018

Probably every navy in the world has it right:  the Captain is responsible for what happens on and to his ship.  If some machinist mate second class screws up and damages a ship's turbine by neglect or ignorance, he is held responsible, but so too is the Captain held accountable because he IS in command.  His job to have competent, trained crew. If someone NOT in the Navy's chain of command (like an observer or contractor) is aboard at sea (and in port in most cases)his safety and his actions are still the Captain's responsibility.

Kelly is and was in command.  The video crews might hand in their time sheets and receive assignments from some support person on the larger football staff or university staff.  Or, they might be given orders by some separate department.  But all of these operations are at the behest of Notre Dame football, whose leader is Kelly. Furthermore
it physically happened where Kelly was present: directly, actively in command.  If he'd wanted the camera tower moved for a different view angle, it would have been. If he wanted a view of a particular play, he could have ordered it. If he looked at the weather and weighed its effect on or threat to his players, he can't draw a fine line and pretend the man on the tower within yards of his players, responding to his official requirements for a video record, is some guy on the level of a visiting vendor.

RE: Kelly Presser - Griffins78 - 09-27-2018

NDIrish - I don't know the details of these two. But wanted to thank you for your respectful explanation of your perspective. They have little bearing on this Saturday's game.

However, Brian Kelly made this subtle dig at Stanford on the Jim Rome Show that Stanford has been good at football for the last 10 years while Notre Dame has been good for over 90 and winning national championships.
