Covid Vaccination impact on teams - OutsiderFan - 06-25-2021

Today, NC State had several players ruled out of its CWS game with Vanderbilt.

Also today, I saw a report that 65% of NFL players have had at least one shot.  If you're reading about the Delta Covid version, you know even one shot isn't gonna help much, and two are needed to effectively stop infections. Some coaches are suggesting that when it comes to final cuts, all things being equal, the vaccinated players will be the ones who survive over unvaccinated.

The NFL isn't mandating vaccinations, but I would imagine some schools will.  Obviously NC State isn't requiring Covid vaccinations. What about Stanford?  Will the schools that require Covid vaccinations actually gain a competitive advantage over those that don't?  I'm reading stuff about how Covid resurgence with Delta could rival what we saw in the Fall of 2020 in places with low vaccination rates, and if schools in those states aren't requiring them, college teams could see big outbreaks like last year.

Personally, I don't think any schools that have outbreaks - because they didn't vaccinate - deserve any leniency in terms of postponements. If your team can't play, it forfeits games and takes an L.

Stanford is requiring all students to be vaccinated in the fall. Over 400 colleges have announced that policy.

I agree. And what conference is likely to get hit? Duh.

OF, Lex is probably going to call for our posts to be deleted. LOL.

Frankly, I can't imagine why any large organization wouldn't require all employees/students to be  vaccinated. No reason to put up with the additional testing/absenteeism due to sickness/quarantine. It is avoidable, so take the simple step to avoid it.

The Stanford track time was getting vaccinated a while ago pretty I saw baseball also. Can’t imagine Stanford athletes on campus weren’t vaccinated

Well, there you have it. If Stanford held on to beat Vanderbilt, odds are they would have beat the depleted NC State team on Friday and had the walkover against them today into the CWS final, with Williams available for Game 1. So that loss on Wednesday was more costly to Stanford championship aspirations than it first appeared. But will there be an asterisk for this year's champion given the NC State situation?

There should be, but you can bet whoever wins will ignore it.

(That would've included us had we won.)

Because they can’t if employees are coming into an office. Legal issues. Won’t discuss here. But that is the reason.

Williams probably would have pitched in some capacity yesterday in an all hands on deck approach.

As martyup said...one strike. =(

I disagree with your conclusion on legal issues. I think employers can (and will) require employees to be vaccinated.  And that it will be upheld (already one federal court on that side of the ledger - though I'm sure many more challenges will come).

well my employer in the Valley is requiring your to attest, but you do not have to show documentation, that you have been vaccinated to be allowed back into company offices (not just locally but around the world).  If you do not you can work remotely.  I would imagine that if for some reason you lied about being vaccinated and the company found out they could fire you for that.  I would guess that if you had a job where you had to go to other company premises (mostly sales or on-site customer support) that some of those companies will require proof of vaccination to be allowed in as a guest.

RE: Covid Vaccination impact on teams - OutsiderFan - 06-26-2021

On the employer mandate issue, teejers is correct. At-will employment seems to apply. Employers can hire whoever they want - as long as they aren't choosing based on gender, age, appearance, sex orientation, religious affiliation - and they can let people go who don't get vaccinated too. How would it make any sense to prevent an employer from protecting its employees and business by forcing them to employ unvaccinated people that put them at risk?

The only reason the sports leagues aren't mandating vaccinations is because of CBA issues. Higher education has same justification to require vaccinations as employers do.

But it seems the odds are high the sports leagues will pay a price for not working out some kind of agreement with unions to require vaccinations and/or penalize players who don't get vaccinated.

Obviously, what makes perfect sense to you and me doesn't make any sense at all to some other people. The "legal" situation on many issues "don't make sense". However, in this case I strongly suspect that employers do have the right to enforce health and safety standards. How far they can go in doing this has bounds. It would not absolutely amaze me if the courts eventually decided vaccination requirements were a bridge too far, but up until now, no court I am aware of has done this.

Deleted. Promised myself I wasn’t going to debate this on a sports board….I will say the issue is way more complex than OF suggests. Plus there is a practical element. Many employers are having difficulty getting their people to come back to work. I don’t think they’re gonna wanna make it that much more difficult. In any event not the place to debate this. I do invite people to read Cal OSHA’s regs on this.

But I will say this, as it’s sports related: OF do you believe the MLB players Union would agree that the players must be vaccinated or they can’t play? I suspect that’s highly unlikely.

I suspect the answer is no, but I also know most people can negotiate compromises or be bought off. I don't know what a negotiated settlement might look like for player unions and leagues.

If I was ownership, I would request salary forfeits for players who get Covid, are not vaccinated and are forced to miss time due to agreed to league safety protocols, and not require salary forfeits from players who get Covid, are vaccinated, and are forced to miss time due to league safety protocols. As usual, there are no easy answers.

Yes, at the very least, employers have to provide exemptions for health (due to the ADA) and sincerely held religious beliefs (due to the first amendment).  But I think the bigger issue is practical, as you mention.  Employers have to pick their battles on what sorts of things they should mandate of their employees.

1. The employer dilemma in getting people physically back to work has nothing (or close to nothing) to do with a vaccination requirement; but rather, the fact that people like working from home and valuable employees will be accommodated.  THAT is the problem . . . afaict.

2.  Lex, why do you think the union would oppose a vaccination requirement?  And btw, OF's compromise seems very reasonable.

As the Delta Variant and possibly other strains devastate the South this Fall does anybody doubt that the SEC will soldier on?

not at my company but friends at some others that have unlimited free food and other on-site benefits are chomping at the bit to return, some asked their employer if they would get a food stipend to compensate them for having to buy their own food while they were forced to work from home.....the answer was no......
