Hi,

Maybe not a lot on this board follow CFB in the SEC as much as I do, but here at following link, is an interesting report about a great QB at University of Tennessee, and how the going NIL rate for a Starting QB at a Top20 program, might be 3.5-4 Million/Year.

Well, I don't think that too many of us need to be reminded that in the college revenue sports these days, it's all about the $$$$$.
Players refusing to practice while their NIL gets renegotiated hits a new low, IMO.

Sounds like agent puffery. In the House settlement era, what school is going to allocate $4M of its $20M to a QB.

I think that I read that NFL QBs get 22% of the salary cap on average.

As others have noted, the fair value calculation may be subject to litigation.

Except the concept of "fair value calculation" is clearly an illegal restraint of trade by a non-governmental organization. There is no "salary cap" on American businesses. They can pay arbitrarily crazy amounts for NIL whether they actually use any of the NIL involved. Obviously I could be wrong, but I see no way this survives the inevitable legal challenge.

I can tell you that is not true when we hire consultants in my industry because of the potential for it to be viewed as an illegal kickback.  We are not strictly limited to FMV calculations, but if we deviate from them, there needs to be a clear justification.  I suspect that will be the case for athletes.

I can see that, because in Biotech there may be a reason to believe that the consultant could have influence in other matters. It is an internally created restriction, not an external one. That is a completely different situation. Your firm just doesn't want to risk a lawsuit. Your lawyers are the "problem". There is no "bureau of consultant compensation" run by a third party that tells you what you may pay. I would also suggest that often consulting contracts contain non-compete clauses that make it attractive to hire a consultant just to ensure no competitor can. Nobody can file suit over that.

I can think of no reason anybody could sue a third party for "overpaying" for an NIL contract to a college athlete. Their is no improper conduct involved. The athlete is being paid to meet the requirements of the contract. If that involves maintaining a position on a college football team, so what? Nothing illegal about that. A certain code of conduct may also be involved, along with a particular hair length. Again, so what?

from the Athletic:

Iamaleava threw for 2,616 yards with 19 touchdowns and five interceptions last year in his second season, first as a starter. Eleven of those 19 touchdowns came against Chattanooga, UTEP and Vanderbilt. He was eighth in the SEC in yards per attempt in conference games.

His stats appear not to be of the elite class, but he did get his team into the playoffs.  What happens if cannot land a deal at least equal to what he was getting at Tennessee? Does he take a lesser amount, fire his agent?  Or does he sit out a year, in hopes of getting a better deal next year, petition the NFL to be eligible to be drafted, or play in the XFL (whatever the name is of the other league) or enrolled at CalTech and major in Space Physics?

I was more surprised to see Duke in the article I saw ponying up $4 million for I think Mensah. That really would make it look like $4 million is the baseline for a qb. Wow.

Regarding the thoughts about an eventual decision that the athletes would be treated as employees who would participate in collective bargaining:

Isn't that going to wind up with the 100,000 athletes voting in favor of everyone splitting basically equally, while the 10,000 or so multi-millionaires having to find different employment?  Or would the collective not have democratic decision making?

Before any collectively bargained contract is developed, the constituency of the bargaining unit will need to be determined.  In this instance, I suspect the unit will consist exclusively of football players.  Much like the NFL, I would expect the membership will agree to an overall salary cap that is distributed by team management according the perceived value of each position on the team.  In other words, the QB’s will make the most and the special teamers will make the least.  

One big question mark is how the NLRB would determine the definition of a unit. Should all players be lumped into one unit or should they be segregated into multiple units (by conference) or should there be another means of defining a bargaining unit?

QB is no longer on the roster.  Sounds like both sides basically said good riddance.  In his first public comments the Tennessee coach said they will look in the transfer portal for a QB.  Good figure, sign of the times.
