Okay, I'll bite. I asked the two questions because on the face it would seem unlikely that a single word as common as "the" would be granted a trademark by the USPTO. However, if the application sought protection for a particular drawing of the word it would stand a better chance. Here is an expert's take:

Quote:“In order for a trademark to be registered for a brand of clothing, the trademark must be used in a trademark fashion,” he said. “In other words, it has to be used on tagging or labeling for the products. In this case, just putting the word ‘the’ on the front of a shirt is not sufficient trademark use.”

I tried owning a ten letter word once but found that Al Swearingen had copyrighted it.

At least one other institute of higher learning uses "The" in front of its name: The Scripps Research Institute in La Jolla, which goes by the initials TSRI.
