If someone gets a tattoo, and the tattoo artist copyrights the tattoo, does a video game need to license that copyright in order to display said copyrighted tattoo?

Not a lawyer, but I bet judges absolutely love writing decisions like this where both sides basically lose. The artist gets satisfaction of winning the case but no money. The video game company gets to keep their measly couple thousand dollars but have no security from future (ridiculous, like come on) tattoo art claims. The lawyers and judge get paid.
