The Constitution is not a death pact. Where the exercise of Constitutional rights presents a clear and present danger to public health or safety, I'm pretty sure the courts would rule against such exercise. Interestingly enough, the "clear and present danger" standard has been previously used to guide restrictions on the 1st Am free speech rights.
