Unlike many schools, Notre Dame has a slight majority of male undergraduate students, and I believe Title IX just says that students need to be given equal opportunities, not that the same number of scholarships is available for each, and if memory serves (and increasingly, it doesn’t), practically it means that scholarships should be proportional to undergraduate demographics.  At most schools, where women outnumber men, sometimes by a fair bit, that means that there should be more women’s scholarships than men’s.

One other thing that I vaguely remember is that schools that schools need only to be “making progress” towards sex equality; they don’t have to be there yet.  So, if Notre Dame was out of compliance, but said that it was planning to cut men’s scholarship spots, they might be ok.
