FSU to file lawsuit to get out of ACC -
needle - 12-22-2023
Typos here from the local paper, but you get the gist that FSU wasn't happy with Stanford, Kal and SMU joining the ACC:
Quote: "On September of 2023, over the strenuous objections of FSU and other ACC members. the ACC added three members. The new members are widely respected academic institutions but not strong tier one need of detail, don't have strong tier one me feel in football, and as the, as the Chairman said, the result of that is to actually diminish the bargaining power of the ACC for its media rights," said David C. Ashburn is Managing Shareholder of the Tallahassee Office.

On the current cost to leave:
Quote: An outside attorney, David Ashburn, is going through financial figures now. He said the penalty to leave the ACC is $572 million.

Here's the complaint:

Well, hello to you, too! From the complaint:
Quote: In demonstration that the ACC had missed the point of conference realignment, in
making its ‘strategic’ conference realignment move, the ACC skipped over Oregon State in favor
of Cal and Stanford, a recognition the ACC did not appreciate what had driven the Power Four
Conference realignment in the first instance – Tier I media value in football.

This was an interesting detail from FSU lawyers.

Quote:FSU lawyer says that ESPN has a "unilateral" right to exercise a nine-year option to extend its media deal with the ACC from 2027 through 2036. (Which it hasn't yet.) Right now, there is no guaranteed media rights revenue for ACC members past 2027.
Not sure how true it is. And I think ESPN would definitely trigger that extension rather than lose schools to a non ESPN league. But if true it makes our jump over to ACC an even bigger leap of faith than we had initially presumed.

Also amusingly it seems ACC beat FSU to the punch, as they actually filed suit aginst FSU yesterday, in North Carolina.

I know the GC for the ACC well, and she's a baller. This does not surprise me at all. The ACC's outside counsel is also really good, so FSU will be in for a dogfight.

What is FSU's end game here? Going independent is not really an option. If they want the big money, it's Big 10, SEC or bust. And neither conference has shown any interest in adding new teams.

If Oregon State had Tier I media value in football, they would be in the Big10, or would have been the first team added to the Big12. FSU attorneys seemed to have filed a complaint based upon evidence of the world as they wish it to be, not the world that is.

I'm not following, wasn't it FSU's complaint that the ACC skipped over OSU in favor of Cal and Stanford?

Supposedly Big10 would take FSU, or SEC would take them to prevent Big 10 from doing so. These are from unnamed sources of course, which could just mean some FSU boosters.
I think their endgame is hope to get some sort of ruling that mitigates the very large leaving penalty to the point where it could be financially viable to jump. From what I can tell that seems pretty unlikely, so maybe this is just bluster to try and force more unequal revenue shares or something. Maybe they feel forced by their fans to do something after getting jumped in playoffs, even if it will amount to nothing.

Yes, skipping over OSU in favor of Cal and Stanford was part of FSU's complaint, not the ACC's:
https://x.com/johncanzanobft/status/1738261162914164861?s=20
And it was a cherry-picked, counterfactual claim:
https://x.com/wilnerhotline/status/1738266039518179330?s=20
I'm not a lawyer, but this looks like sour grapes on FSU's part. They're going to lose, but they may achieve their goal of stirring the pot enough to trigger more chaos and realignment.

Thanks your post and updated info.
However, I do not agree that our jump to the ACC was a leap of faith. It was a desperate jump to our only remaining option with any real hope to stay relevant in many top national sports. It is to the amazing scrambling capability and credit of Condi Rice and others, that gave us even this last remaining option. Otherwise we'd be in the same boat as OSU/WSU, which, setting aside the thoughts about the future of football, can it even be fathomed the decimation that would have caused to numerous of our top teams of soccer, volleyball, swimming, basketball (women's at least, men's remains on a hopeless treadmill regardless), baseball, softball, etc? And as regards to football itself, I would not have been surprised if a lack of joining a Power 5 (now 4) conference would have led to the decommit of more recruits, lack of return of any seniors, more transfer portal departures of key players, and the departure of Coach TT and other of his staff right after this past season ended.

My very non-legal opinion is that if FSU had a strong case, Clemson would have joined in the suit somehow.

That would have been problematic since the case was filed in a Florida court. I suspect Clemson is watching the proceedings with an eye on filing a case in South Carolina if the courts in Florida look favorably upon the Seminoles plea.

So the Noles are using AI to write legal briefs? Stay classy Tallahassee!
Karmic justice will have Free Shoes U in some garbage conference with the Beavers. Because they are so awesome!
I can't quite make myself pull for UGAg over FSU, but can "make" myself not watch it at all and hope both schools find a way to puke on their shoes.

well given FSU will be on their 3rd QB (QB 2 entered the transfer portal given FSU is actively looking for a transfer to replace him) and a number of others won't be playing due to either leaving for the draft or portal entry I'd guess UGA will steamroll them....
