Probably every navy in the world has it right: the Captain is responsible for what happens on and to his ship. If some machinist mate second class screws up and damages a ship's turbine by neglect or ignorance, he is held responsible, but so too is the Captain held accountable because he IS in command. His job to have competent, trained crew. If someone NOT in the Navy's chain of command (like an observer or contractor) is aboard at sea (and in port in most cases)his safety and his actions are still the Captain's responsibility.
Kelly is and was in command. The video crews might hand in their time sheets and receive assignments from some support person on the larger football staff or university staff. Or, they might be given orders by some separate department. But all of these operations are at the behest of Notre Dame football, whose leader is Kelly. Furthermore
it physically happened where Kelly was present: directly, actively in command. If he'd wanted the camera tower moved for a different view angle, it would have been. If he wanted a view of a particular play, he could have ordered it. If he looked at the weather and weighed its effect on or threat to his players, he can't draw a fine line and pretend the man on the tower within yards of his players, responding to his official requirements for a video record, is some guy on the level of a visiting vendor.
