And the fix is easy - another bathroom.  But perhaps that's too simplistic.

Being familiar with construction, I can safely say that such a fix is not easy.  If an additional bathroom was required at all public facilities, let alone private facilities open to the public, the cost would be in the billions.

The less costly fix would be to make all public accessible bathrooms gender neutral.  However, this would not end the debate about pointers and setters in the same bathroom.

Do what you reasonably can.  In public facilities with lots of bathrooms - stadia, schools, etc. - reallocate designations on existing bathrooms.  For all new construction or remodels, require 3 bathroom types.  For restaurants that only have one of each, do nothing (or make both gender-neutral for single use).  

There is no constitutional right to pee in the bathroom of one's choosing.  And if some people have to be "uncomfortable," then I'd lean toward making the fewest people uncomfortable (which means status quo remains for those places that can't make change(s) above).
